Buzz360, LLC (“Buzz360”, “us”, “we”, or “our”) is committed to protecting your privacy. This privacy policy is intended to clearly explain what we consider to be “personal data”, what we consider to be “anonymous data”, and how this information is collected, used, and disclosed by Buzz360. 

By visiting SwipeRed, accessing the Buzz360 services (“Services”), or doing business with Buzz360, you are accepting the practices described in this privacy policy and expressly consent to the use and potential disclosure of your Personal Data in accordance with this Privacy Policy. If you disagree, disapprove, or do not wish to comply with this Privacy Policy, please immediately discontinue visiting our website and using our Services.

The Types of Data We Collect and Store 

Buzz360 is a privately owned company that provides voter data products and services to political organizations, operates Software-as-a-Service (SaaS) subscription services, software applications, voter data files and other services through our website or through mobile apps, including SwipeRed products and services (all of such software applications and services the “Services”), , and maintains the website Buzz360.app (the “Site”). 

In the process of doing business and providing the Services, Buzz360 collects and maintains information classified as both “Personal Data” and “Anonymous Data” using the following definitions:

a. Personal Data – “Personal Datameans data that allows someone to identify or contact you, including, for example, your name, delivery address, telephone number, e-mail address, voter registration information we provide you through use of the Services, as well as any other non-public information about you that is associated with or linked to any of the foregoing data. 

b. Anonymous Data – “Anonymous Data means data that is NOT associated with or linked to your Personal Data; Anonymous Data does not, by itself, permit the identification of individual persons. 

It is important to understand Buzz360 stores and maintains personal data that has been collected or acquired through different methods, with different levels of detail and different ownership rights. These methods include the following: 

  1. Buzz360 Client, System User, or Website Visitor Information (Client Data) – Individuals that use the Services or purchase data or services directly through a Buzz360 account representative may be required to provide personal data for direct communication, or creating a unique user account. This information may range from billing information to the user’s IP address. We collect and store this information to support Buzz360’s client /marketing communications, enhancement of client’s online experience, and to provide online security and system performance. Buzz360 does NOT sell or share in any form any of such personal data or user information with any third-party entities.
  2. Information Submitted to the Site or While Using the Services – Users of the Services will frequently add or input personal data to our Site through data entry and bulk import functionality (such data, “Submitted Data”). The purpose of Submitted Data is to enhance the individual information for a voter or proprietary contact data. All information created and added to the Site by the user is exclusively owned by the contracted entity that provided payment for the data or software purchase or other Services. Buzz360 does not sell or share in any form Submitted Data with any third parties.

Some organizations may desire to share data through the use of the Services with another Buzz360 account used by another organization using our Services. The Services includes software that has data sharing functionality that utilizes a specific protocol requiring active consent from the organization sharing and receiving the data. 

PDI sales or support team members are not authorized to provide any account information that could assist in the configuration of data sharing between two or more client organizations. 

Submitted Data acquired by an organization can be exported at any time by such organization’s account administrator. 

  • Donation / Purchase Processing (Financial Transaction Data) – The Services supports custom webforms designed to process financial data. PDI uses third party components activated by the account owner to manage the financial transactions. To be clear, Buzz360 does not store credit card information. 
  • Voter Information (Voter File Data) – Some of the Services provides voter data derived from government agencies to organizations permitted to use voter data under state or local law. Access to voter data is limited in how it may be used as well as the duration under the applicable purpose. Under no condition is access to voter data ever granted in perpetuity. While the exact voter data fields vary from state to state, they commonly include Name, Address, Birth Date, Gender, Party, Phone Number, and Email Address as provided by individuals on their voter registration forms. Buzz360 has no authority to provide voter data or permit the use of voter data beyond the scope of applicable state or local law. Buzz360 does not make any changes to voter data that could possibly impact a voter’s eligibility or status. We do not have the authority to add or remove voters on behalf of any government elections agency. It is the responsibility of individuals using Buzz360 voter data to determine whether their use of the data is legally permissible. Voter data may never be used for personal or commercial use. Traditional political campaign methods often require the exporting of paper or electronic lists which can be provided by the Services . The organization purchasing the list or software subscription is responsible for protecting the privacy of individuals contained on such lists or files. All lists and electronic files that you obtain through use of the Services should be stored with personal privacy in mind and destroyed immediately after using. We ask that all users of the Services maintain and store these lists and files with a respectful consideration of the personal privacy of the individuals contained on these lists and files. Please treat these lists and files as if your personal information is included. 

Disclosure of and Use of Personal Data 

We do NOT sell your Personal Data for commercial use and will only use or disclose Personal Data, subject to applicable law, as described below and as described elsewhere in this Privacy Policy.

  • Third Party Service Providers – Buzz360 may share Personal Data with third-party service entities under the following conditions: to conduct quality assurance testing; to facilitate creation of accounts; to provide technical support; and for benchmarking and research purposes associated with the performance of Services. These third-party service providers are contractually prohibited from using Personal Data for any purpose other than providing the previously stated services. We will remain responsible to you for Personal Data and require third-party services providers to adopt strict adherence to the terms of this Privacy Policy. 
  • Other Disclosures – Regardless of any choices you make regarding your Personal Data (as described below), we may disclose Personal Data if we believe in good faith that such disclosure is necessary (a) in connection with any legal investigation; (b) to comply with relevant laws or to respond to subpoenas or warrants served on us, our partners or third-party services providers; (c) to protect or defend our rights, property and/or other users of Services; and/or (d) to investigate or assist in preventing any violation or potential violation of the law or breach of our agreement with you.

Automatically Collected Information

When you access or use Services, we may automatically collect information about you, including:

  • Log Information – We log information about your use of Services, including the type of browser you use, access times, pages viewed, your IP address and the page you visited before navigating to the Services. 
  • Device Information – We collect information about the computer or mobile device you use to access Services including the hardware model, operating system and version, unique device identifiers and mobile network information. 
  • Information Collected by Cookies and Other Tracking Technologies – We use various technologies to collect information, and this may include sending cookies to your computer or mobile device. Cookies are small data files stored on your hard drive or in device memory that helps us to improve Services and your experience, see which areas and features of Services are popular and visit counts. We may also collect information using web beacons (also known as “gifs,” “pixel tags” and “tracking pixels”). Web beacons are electronic images that may be used in connection with Services or emails and help deliver cookies, count visits, understand usage and campaign effectiveness and determine whether an email has been opened and acted upon. For more information about cookies, and how to disable them, please see “Your Choices” below. 

Email Communications

We may periodically send you e-mails that directly promote the use of Services. When you receive communications from us, you may indicate a preference to stop receiving further communications from us and you will have the opportunity to “opt-out” by following the unsubscribe instructions provided in the e-mail you receive or by contacting us directly (please see contact information below). Despite your indicated e-mail preferences, we may send you service-related communications, including notices of any updates to this Privacy Policy.

Data Security 

Buzz360 uses standard industry security measures to help protect your information from loss, theft, misuse and unauthorized access, disclosure, alteration and destruction of Personal Data. Unfortunately, it is impossible to guarantee that Personal Data is 100% secure. Please store passwords in a safe place and sign out when you are not in close proximity to your device. You are solely responsible for all activity done through your account and will immediately notify us at security@buzz360.co if you have reason to believe that your account has been compromised. 

Third Party links 

Services include links to third-party websites. Some third-party websites may collect data or solicit personal information from you. We neither own nor control such third-party websites and are not responsible for their content or actions. Please read the terms and conditions and privacy policies of any third-party website that may be linked to Services. 

Your Choices 

  • Account Information – You may update, correct or delete information about you at any time by logging in to your account. If you would like to cancel your account entirely, please contact us, and enter your request for cancellation, but please note that we may retain certain information as required by law or for legitimate business purposes. 
  • Changing or Deleting your Customer Personal Data – You may change any of your information (“Customer Data”) in your account by editing your profile within your account or by sending an e-mail to us at privacy@buzz360.co or calling (612) 567-0396. You may request deletion of your Customer Data by us, and we will use commercially reasonable efforts to honor your request, but please note that we may be required to keep such information and not delete it (or to keep this information for a certain time, in which case we will comply with your deletion request only after we have fulfilled such requirements). When we delete any information, it will be deleted from the active database, but may remain in our archives. We may also retain your information for fraud or similar purposes. Please note that the policies described in the section may not apply to Personal Data associated with registered voter records. 
  • Cookies – Most web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove or reject browser cookies. Removing or rejecting browser cookies does not necessarily affect third-party flash cookies used in connection with Services. Please note that if you choose to remove or reject cookies, this could affect the availability and functionality of the Site. 

Changes to this Privacy Policy

We may change this Privacy Policy from time to time. If we make changes, we will notify you by revising the date at the top of this Privacy Policy, and when possible, we may provide you with additional notice (such as adding a statement to the homepage of our Site or sending you an email notification). 

Any changes will be effective immediately upon posting of the revised Privacy Policy and your continued use of the Services indicates your consent to the then current Privacy Policy. If you do not agree, you may discontinue use of the Services. We encourage you to review the Privacy Policy whenever you interact with us to stay informed about our information practices and the ways you can help protect your privacy. 

To the extent any provision of this Privacy Policy is found by a competent tribunal to be invalid or 

unenforceable, such provision shall be severed to the extent necessary for the remainder to be valid and enforceable. 

Children’s Privacy 

We do not knowingly collect personally identifiable information from anyone under the age of 13. If you are a parent or guardian and you are aware that your chil has provided us with Personal Data, please contact us. If we become aware that we have collected Personal Data from children without verification of parental consent, we take steps to remove that information from our servers. 

California Consumer Privacy Act – CCPA (Effective January 1st, 2020)


The CCPA, was passed by the California State Legislature in AB375 in 2018 and signed by the Governor that year. Subsequent legislation AB25, AB874, AB1146, AB1355 and AB1564 made modifications to the law. The total of these legislative protections take effect on January 1, 2020. 

The CCPA places important protections on commercial use of personal data collected by entities doing business in California. It allows consumers to view any data collected on them, restrict use of that data and even have their data deleted under most circumstances. 

Buzz360  is required to comply with the CCPA for data that is acquired from our public website (politicaldata.com) and sales process. Buzz360 is not required to comply with the CCPA for Personal Data associated with registered voters. Any adherence to the CCPA with regard to Personal Data associated with registered voters would be strictly voluntary and conditional. Please continue reading this section for more specific details. 

The law creates two important exemptions for those working within areas of political free speech, governmental, and legitimate research. These can be found in two key sections of the new law: 

Cal. Civ. Code § 1798.105 (d) (4) A business or a service provider shall not be required to comply with a consumer’s request to delete the consumer’s personal information if it is necessary for the business or service provider to maintain the consumer’s personal information in order to exercise free speech, ensure the right of another consumer to exercise his or her right of free speech, or exercise another right provided for by law. 

Cal. Civ. Code § 1798.140 (f) For purposes of this title: “Commercial purposes” means to advance a person’s commercial or economic interests, such as by inducing another person to buy, rent, lease, join, subscribe to, provide, or exchange products, goods, property, information, or services, or enabling or effecting, directly or indirectly, a commercial transaction. “Commercial purposes” do not include for the purpose of engaging in speech that state or federal courts have recognized as noncommercial speech, including political speech and journalism. 

Amendments to the law in 2019 went further in three areas that provide additional protections for Buzz360 clients that use data that we provide as part of our Services. These amendments to the law provide that data legally made available from federal, state or local governments is excluded from the provisions which apply to “personal information.” (Civil Code Section 1798.140 (O) (2)). These amendments further clarified that data such as voter files, political donor data, and other data commonly used by PDI is not subject to the provisions. 

These amendments also provided greater clarity by defining “personal information” in a way that exempts de- identified or aggregate consumer data. (California Civil Code Section 1798.145 (a) (5)) This is the kind of data utilized by Buzz360 in modeling and other voter targeting, and the amendment expressly excludes this data from the consumer protections under this law. 

California Privacy Rights 

California residents, in addition to the above Privacy Rights, are also entitled to certain additional information and have certain additional rights under the California Consumer Privacy Act (“CCPA”) as stated below. 

Information We Collect and How We Use It 

Below is a summary of our collection and use of “personal information” (as defined by the CCPA) about Consumers in connection with our Services. For additional details, please consult the other sections of this Privacy Notice. 

Categories of personal information we may collect and use for our commercial and business purposes:

  • Contact and account registration information. When you register for an account or contact us you may provide your name, email address, physical address, phone number, account username and password, electronic signature, and other related information. 
  • Financial or payment information. We collect information about payment methods that you provide, billing information, and information about the Services you subscribe for purchase. 
  • User information. When you use the Services, we may collect names and email addresses of parties using the Services and personal information about those individuals or their devices, such as name, email address, IP address, and authentication methods. 
  • Customer communications. We collect information about your customer service communications with us, including, for example, questions and other messages you address to us directly through online forms, by email, over the phone, or by post. 
  • Information about your web browser, mobile device, or internet connection. When you access our Services online, we may automatically collect IP address, device identifiers and device attributes, including cookie IDs, mobile advertising IDs, and other similar unique identifiers, data about how you interact with the Services online (usage data), location information (e.g., city, state, country, and ZIP code associated with your IP address or derived through Wi-Fi triangulation) and, with your permission in accordance with your mobile device settings, precise geolocation information from GPS-based functionality on your mobile device.

Purposes for which we use the personal information we collect:

  • Provide you with and collect payment for the Services you request. 
  • Create your account and communicate with you. 
  • Market our Services by sending you emails. 
  • Test changes in our Services and develop new features and products. 
  • Fix problems you may have with our Services, including answering support questions and resolving disputes.
  • Manage the Services platform including support systems and security. 
  • Prevent, investigate and respond to: fraud, unauthorized access to or use of our Services, breaches of terms of use and policies, or other wrongful behavior.
  • Comply with legal obligations. 
  • Meet legal retention periods. 
  • Establish, exercise, or defend our rights in legal claims. 

The Right to opt Out of Sales of Personal Information 

Consumers have the right to opt out of “sales” of their personal information under the CCPA. 

No Sale of Personal Information 

 In the preceding twelve (12) months, we have not sold and will not sell any personal information to  nonaffiliated third parties without your consent. We, also, have not and will not sell the personal information of minors under 16 years of age to non-affiliated third parties without affirmative authorization. 

Right to Know About Personal Information Collected, Used, or Disclosed 

You have the right to request that we disclose certain information to you about our collection, use and disclosure of your Information over the past 12 months. Once we receive your request and verify your identity, we will disclose to you: (1) the categories of Information we collected about you; (2) the categories of sources for the Information; (3) our business or commercial purpose for collecting or disclosing that Information; (4) the categories of third parties with whom we shared that Information; and (5) the specific pieces of Information we collected about you in the preceding 12 months. 

Right to Delete Personal Information Collected or Maintained

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your request and verify your identity, we will permanently delete (and direct our service providers to delete) your personal information from our records, unless a legal exception to deletion applies. In our response to your request to delete, we will specify the manner in which we have deleted your personal information or, if we must deny your deletion request, the basis for this refusal. 

Right to Non-Discrimination for Exercise of Privacy Rights 

We will not discriminate against you for exercising any of your rights by: (a) denying you goods or services; (b) charging you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties; (c) providing you a different level or quality of goods or services; or (d) suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services. 

Exercising Your Rights 

To exercise the rights described above, please submit a verifiable consumer request to us by either:

Authorizing an Agent

You may designate an authorized agent to submit your consumer request on your behalf, so long the authorized agent has your written permission to do so and you have taken steps to verify your identity directly with us.

Verifiying Your Request

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. Making a verifiable consumer request does not require you to create an account with us. We will only use personal information provided in a verifiable consumer request to verify your identity or authority to make the request. You may only make a verifiable consumer request for access or data portability twice within a 12-month period.

To verify your identity, we ask that you to provide us with the following information when you submit your request: (1) first name, (2) last name, and (3) phone number or email. We will use the above information to verify your identity. Depending on your type of request or the information requested by you, we may require additional information to verify your identity and fulfill your request.

California law also requires that we disclose how we respond to “do-not-track requests” from our users. At this time, we do not currently respond to “do-not-track” requests from our users’ browsers. 

“Shine the Light” 

California residents may ask for a list of third parties that have received your personal information for direct marketing purposes during the previous calendar year. This list also contains the types of personal information shared. We provide this list at no cost. Buzz360 Master Terms and Conditions of Service

Welcome to the products and services ("Services") provided by Buzz360, LLC, located at 7140 178th St, Lakeville, MN 55044 ("we", "us", "our" or "Buzz360").  By using our Services, you are agreeing to the terms below. Please read them carefully and if you have any questions contact us at terms@buzz360.co.

Structure of Our Terms and Conditions

These Master Terms of Service (the "Master Terms") contain the terms and conditions that apply to all of our Services. In addition to these Master Terms, each of our individual Services may be subject to additional terms and conditions that are specific to those Services only ("Additional Terms"). When you use these individual Services, the applicable Additional Terms will apply to you, and will automatically be incorporated into these Master Terms by reference ("Terms" means these Master Terms, along with any applicable Additional Terms). 

Changes to Services and Terms

Buzz360 regularly updates and improves the Services, and may at times remove features in order to improve your ability to use the Services. Because we are constantly trying to improve our Services, these Terms may also need to change. We reserve the right to change the Terms at any time, but if we do, we will bring it to your attention by placing a notice on the Services, and/or by sending you an email and/or by some other means.

If you don't agree with the new Terms, you are free to reject them; unfortunately, that means you will no longer be able to use the Services. If you use the Services in any way after a change to the Terms is effective, that means you agree to all of the changes.

Except for changes by us as described here, no other amendment or modification of these Terms will be effective unless in writing and signed by both you and us.

Privacy

Buzz360 takes the privacy of its users very seriously. For more information, please refer to the Additional Terms contained in our current Privacy Policy.

Please note that we do not knowingly collect or solicit personally identifiable information from children under 13; if you are a child under 13, please do not attempt to register for the Services or send any personal information about yourself to us. If we learn we have collected personal information from a child under 13, we will delete that information as quickly as possible. If you believe that a child under 13 may have provided us personal information, please contact us at privacy@buzz360.co

Basics of Using the Services

In order to use certain of our Services, you may be required to sign up for an account, and to select a password and user name ("User ID").  You will provide accurate, complete, true and updated registration information about yourself.  You may not select as your User ID a name that you don't have the right to use, or another person's name with the intent to impersonate that person. You may not transfer your account to anyone else without our prior written permission. You will not share your account or password with anyone, and you must protect the security of your account and your password. You're responsible for any activity associated with your account.

You must follow all applicable laws in your use of the Services, including applicable Campaign, Campaign finance, export and re-export control laws and regulations. If your use of the Services is prohibited by applicable laws, then you aren't authorized to use the Services. We can't and won't be responsible for your using the Services in a way that breaks the law. The Services are provided by a U.S. company. We may suspend or terminate services if you do not follow our Terms, and customers removed by Buzz360 may not be allowed any future access to the Services.

The materials displayed or performed or available on or through the Services, including, but not limited to, text, graphics, data, articles, photos, images, illustrations, and so forth (all of the foregoing, the "Services Content") are protected by copyright and/or other intellectual property laws. You will abide by all copyright notices, trademark rules, information, and restrictions contained in any Services Content that you access through the Services, and you won't use, copy, reproduce, modify, translate, publish, broadcast, transmit, distribute, perform, upload, display, license, sell or otherwise exploit for any purpose any Services Content not owned by you, (i) without the prior consent of the owner of that Services Content or (ii) in a way that violates someone else's (including Buzz360's) rights.

You understand that Buzz360 owns the Services. You won't modify, publish, transmit, participate in the transfer or sale of, reproduce (except as expressly provided in the Terms), creative derivative works based on, or otherwise exploit any of the Services. The Services may allow you to copy or download certain Services Content; please remember that just because this functionality exists, doesn't mean that all the restrictions above don't apply – they do!

You understand that any data you enter or upload into the service becomes property of Buzz360 and may be used to improving the service for all users.  You expressly authorize Buzz360 to make the data available to third parties for the purpose of storing, enhancing, processing and using the data to perform the service for you and derive certain conclusions to enhance the service for you and all other users.  Buzz360 will not intentionally rent or sell the data you uploaded to any third party.   

These Terms grant you a non-exclusive, limited, non-transferable, freely revocable license to use the Services, subject to your compliance with all of the Terms. Buzz360 may terminate this license at any time for violation of our terms and policies.

Termination of Services

Unless you have a separate agreement with Buzz360 specifying otherwise, the TeamUpWith subscriptions to our basic service is for a minimum of 12 months.  Subscriptions renew automatically for 12 months terms unless they were terminated in writing no less than 60 days prior to the end of the term. SwipeRed subscriptions renew automatically for 30 day terms unless they were terminated in writing no less than 30 days prior to the end of the term.   

Buzz360 is free to terminate (or suspend access to) your use of the Services or your account, for any reason in our discretion, including your breach of these Terms, non timely payment, etc.  Buzz360 has the sole right to decide whether you are in violation of any of the restrictions set forth in these Terms. Termination or interruption of any of the services are explicitly accepted as remedies under the agreement. (This means, we may shut your website and/or any other service down if you are late with payments for any of our services.)  

Provisions that, by their nature, should survive termination of these Terms shall survive termination. By way of example, all of the following will survive termination: any obligation you have to pay us or indemnify us, any limitations on our liability, any warranty disclaimers, any terms regarding ownership or intellectual property rights, and terms regarding disputes between us.

Acceptable Use Policy

In addition to the general restrictions contained above, your use of our Services is subject to our then-current Acceptable Use Policy, which is a part of the Master Terms.

Responsibility for Content

Content and information displayed on the Services is the sole responsibility of the person or organization providing that content, and you access all such content and information at your sole risk. We aren’t liable for any errors or omissions in that content or information, or for any damages or loss you might suffer in connection with it. We do not review content posted on the Services, and any issues with that content should be directed to its owners. You are solely responsible for interactions with other users of the Services.

The Services may contain links or connections to third party websites or services that are not owned or controlled by Buzz360. When you access third party websites or use third party services, you accept that there are risks in doing so, and that Buzz360 is not responsible for such risks. We encourage you to be aware when you leave the Services and to read the terms and conditions and privacy policy of each third party website or service that you visit or utilize. Buzz360 has no control over, and assumes no responsibility for, the content, accuracy, privacy policies, or practices of or opinions expressed in any third party websites or by any third party that you interact with through the Services. By using the Services, you release and hold us harmless from any and all liability arising from your use of any third party website or service.

If there is a dispute between participants on this site, or between users and any third party, you agree that we are under no obligation to become involved. In the event that you have a dispute with one or more other users, you release Buzz360, its officers, employees, agents, and successors from claims, demands, and damages of every kind or nature, known or unknown, suspected or unsuspected, disclosed or undisclosed, arising out of or in any way related to such disputes and/or our Services. If you are a California resident, you shall and hereby do waive California Civil Code Section 1542, which says: "A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which, if known by him must have materially affected his settlement with the debtor."

Organizational Users

If you're using any of our Services on behalf of an organization or entity, you affirm that you have the right to act on behalf of that organization or entity, and that these Terms apply to the organization or entity (and all references to "you" and similar terms refer to that organization or entity). The organization or entity will hold harmless and indemnify Buzz360 (and its affiliates, officers, agents, and employees) from any claim, suit or action arising from or related to the use of the Services or violation of these terms, including any liability or expense arising from claims, losses, damages, suits, judgments, litigation costs and attorneys' fees. 

Badges

Certain aspects of the Services may allow you to obtain reputational or status indicators, and/or fictional property representing virtual achievements, for instance, political capital ("Badges"). You have a limited license to these Badges and it is not redeemable for any value from Buzz360. We have the right to change or eliminate Badges at any time without liability. 

Disclaimer

We work hard to provide high-performance services and will work with you to provide an excellent customer experience, but there are certain things we don't promise.

Other than as expressly set out in these Terms or Additional Terms, neither Buzz360 nor its partners, suppliers or API application providers make any specific promises about the Services. We don't make any commitments about the content within the Services, the specific function of the Services, or their reliability, legality, availability, or ability to meet your needs. We provide the Services "AS IS" and you use them at your own risk.  To the extent permitted by law, we disclaim all warranties, express or implied, including, without limitation the warranties of merchantability, fitness for a particular purposes, and non-infringement. 

Limitation of Liability

To the fullest extent permitted by law, Buzz360 and Buzz360's partners, suppliers and API application providers will not be responsible (under any legal or equitable theory) for: (1) lost profits, revenues, or data, financial losses, or indirect, special, consequential, exemplary or punitive damages; or (2) any amounts (in the aggregate) in excess of the amount you paid us to use the Services, or (3) any loss or damage that is not reasonably foreseeable or that is outside of their reasonable control.

You explicitly agree that the value of any claim you may bring against Buzz360 will be limited to the amount of subscription payments made during the 12 month prior to the claim. 

Copyright Dispute (DMCA)

We respect others' intellectual property rights, and we reserve the right to delete or disable content alleged to be infringing, and to terminate the accounts of repeat alleged infringers. To report potentially infringing content, contact us at terms@buzz360.co.

Other Terms

We have the rights to enforce these Terms even if we don't do so right away. You cannot reassign the duty to abide by these Terms or your rights hereunder, but Buzz360 may reassign these Terms in order to continue to provide the Services.

The Terms are governed by the internal substantive laws of the State of Minnesota, without respect to its conflict of laws principles. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded. Any claim or dispute between you and Buzz360 that arises in whole or in part from the Services shall be decided exclusively by a court of competent jurisdiction located in Hastings, Minnesota, unless submitted to arbitration as set forth in the following paragraph.

Buzz360 may provide notifications, whether such notifications are required by law or are for marketing or other business related purposes, to you via email notice, written or hard copy notice, or through posting of such notice on the Services, as determined by us. We are not responsible for any automatic filtering you or your network provider may apply to email notifications we send to the email address you provide us. We recommend that you add terms@buzz360.co and Info@buzz360.co to your email address book to help ensure you receive email notifications from us.

The Terms, together with any amendments and any additional agreements you may enter into with Buzz360 in connection with our Services, shall constitute the entire agreement between you and Buzz360 concerning the Services. You may be subject to additional third-party terms and policies based on your use of the Services. If any provision of these Terms is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect.

No agency, partnership, joint venture, or employment is created as a result of these Terms and you do not have any authority of any kind to bind Buzz360 in any respect whatsoever. You and Buzz360 agree there are no third party beneficiaries intended under these Terms.

No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such term or any other term, and Buzz360's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

Changes to This Policy

We're constantly trying to improve our Services, so we may need to change this Acceptable Use Policy from time to time as well, but we will alert you to changes by placing a notice on the Services, by sending you an email, and/or by some other means. Please note that if you've opted not to receive legal notice emails from us (or you haven't provided us with your email address), those legal notices will still govern your use of the Services, and you are still responsible for reading and understanding them. If you use the Services after any changes to the Master Terms of Service or changes to any other terms and conditions have been posted, means you agree to all of the changes.

Buzz360 Acceptable Use Policy

These additional terms apply to your use of the Services provided by Buzz360. Please note that the Buzz360's Services are at all times subject to our Master Terms and Conditions of Service located at www.buzz360.co/terms (the “Master Terms”), which incorporate this Acceptable Use Policy. Any terms we use in this Acceptable Use Policy without defining them have the definitions given to them in the Master Terms.

When you use the Services (including any posting or uploading or information or content), you must not:

  • use the Services outside of the interfaces we have provided or remove or alter notices or logos provided with the Services
  • engage in any unsolicited advertising, marketing or other activities, including, without limitation, any activities that violate anti-spam laws and regulations including, but not limited to, the CAN SPAM Act of 2003, the Telephone Consumer Protection Act, and the Do-Not-Call Implementation Act (note: while the Services may include features intended to assist you in complying with these legal obligations, you will remain fully responsible for any non-compliance even if you use such features)
  • conduct penetration tests of any Services-related system or network
  • use extreme bandwidth capacity in a way that threatens our infrastructure
  • attempt to access other users data that you are not authorized to access
  • upload viruses or malware or attempt to overload the system with email or traffic
  • promote commercial services that are not your own unless you are authorized to do so
  • infringe or violate the intellectual property rights, privacy rights or any other rights of anyone else (including Buzz360)
  • violate any law or regulation, including (without limitation) copyright infringement, child pornography, or inciting violence.
  • post or upload any content that, in Buzz360's reasonable discretion, may expose Buzz360 to civil or criminal liability
  • jeopardize the security of your Services account or anyone else's (such as allowing someone else to log on as you on the Services)
  • attempt, in any manner, to obtain the password, account, or other security information from any other user
  • violate the security of any computer network, or crack any passwords or security encryption codes
  • "crawl," "scrape," or "spider" any page, data, or portion of or relating to the Services or any content available through the Services (through use of manual or automated means)
  • decompile, reverse engineer, or otherwise attempt to obtain the source code or underlying ideas or information of or relating to the Services.

A violation of any of the foregoing is grounds for termination of your right to use or access the Services. 

 

Changes to This Policy

Changes to this policy are governed by the Master Agreement.

We at Buzz360 care about how your personal information is used and shared, and we take your privacy seriously.

By using or accessing the Services in any manner, you acknowledge that you accept the practices and policies outlined in this Privacy Policy, and you hereby consent that we will collect, use, and share your information in the following ways. Remember that your use of Buzz360's Services is at all times subject to our Master Terms of Service located at www.buzz360.co/terms (the “Master Terms”), which incorporate these Additional Terms. Any terms we use in these Additional Terms without defining them have the definitions given to them in the Master Terms.

What does this Privacy Policy Cover?

This Privacy Policy covers our treatment of personally identifiable information ("Personal Information") that we gather when you are accessing or using our Services, but not to the practices of companies we don't own or control, or people that we don't manage. We gather various types of Personal Information from your and other parties who's information you provide. We use this Personal Information internally in connection with our Services, including to personalize and improve our services, to allow you to set up a user account and profile, to contact you and allow other users to contact you, to fulfill your requests for certain products and services, to provide and improve the Services, and to analyze how you use the Services. In certain cases, we may also share some Personal Information with third parties, but only as described below.

Please note that some of our Services may allow you to provide us with Personal Information regarding your own users, visitors, supporters or voters ("Third Party Personal Information"). This Privacy Policy deals with our use of your own Personal Information, and not Third Party Personal Information that you may provide to us in connection with the Services.

We are not responsible for the practices of sites linked to or from the Services, or for the privacy practices of our other customers on the Services, and before interacting with any of these sites you are advised to review their rules and policies before providing them with any private information.

As noted in the Master Terms, we do not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to register for our Services. If you are under 13, please do not send any information about yourself to us, including your name, address, telephone number, or email address. No one under age 13 is allowed to provide any personal information to or on the Services. In the event that we learn that we have collected personal information from a child under age 13 without verification of parental consent, we will delete that information as quickly as possible. Information We Collect 

When you sign up for the Services, you provide us with information such as your name, phone number and email address. We may also collect information from your public social media accounts.

When you use the Services, we may send cookies - small text files containing alphanumeric characters - to your computer to identify your browser and help enhance your experience with the Services. You can set your web browser to refuse all cookies or to indicate when a cookie is being sent. Some features of the Services may not function properly if the ability to accept cookies is disabled. We may use tiny images known as clear GIFs to track behavior of users, including statistics on who opens our emails.

Our servers automatically record certain log file information reported from your browser when you access the Services. These server logs may include information such as which pages of the Service you visited, your internet Protocol ("IP") address, browser type, and other information on how you interact with the Services.

Any non-public phonebooks you may upload into the Buzz360 system will not be shared with 3rd parties. We do not allow unauthorized publishing or disclosure of any users non-published contacts. Any sharing of individual contacts can only be initiated and authorized by the owner of the contact and requires their specific and explicit instruction.

Buzz360 uses Google Analytics to help us understand use of our Services.

Financial information connected to payments may be collected or stored by a third-party payment processor and is subject to their terms and policies.

How We Use Your Information 

We use the personal information you submit to operate, maintain, and provide to you the features and functionality of the Service. Buzz360 may use certain information about you internally for purposes such as analyzing how the Service is used, diagnosing service or technical problems, maintaining security, and personalizing content.

By providing Buzz360 your email address (including by "following," "liking," linking your account to the Buzz360 service, etc., on a third party website or network), you consent to our using the email address to send you Service-related notices, including any notices required by law, in lieu of communication by postal mail. You also agree that we may send you notifications of activity on the Service to the email address you give us, in accordance with any applicable privacy settings. We may use your email address to send you other messages, such as newsletters, changes to features of the Service, or special offers. If you do not want to receive such email messages, you may unsubscribe using the link in the emails.  Opting out may prevent you from receiving email messages regarding updates, improvements, or offers. You may not opt out of Service-related e-mails.

Following termination or deactivation of your account, Buzz360 may retain your profile information and all information posted to the Service.

If  you - as an advocate user of our mobile app - select the "Delete All Contacts" or "Delete My Account" options in the mobile apps your personal non-published contacts and data will be deleted, to the extend you had not shared it before.

We use cookies, clear gifs, and log file information to: (a) remember information so that you will not have to re-enter it during your visit or the next time you visit the site; (b) provide custom, personalized content and information; (c) monitor the effectiveness of our Service; (d) monitor aggregate metrics such as total number of visitors, traffic, and demographic patterns; (e) diagnose or fix technology problems reported by our users or engineers that are associated with certain IP addresses; (f) help you efficiently access your information after you sign in; and (h) track user Content and users to the extent necessary to comply as a service provider with the Digital Millennium Copyright Act.

How We Share Your Information 

Personally Identifiable Information: Buzz360 will never rent or sell your personally identifiable information to others. Buzz360 may share your personally identifiable information with third parties for the purpose of providing the Service to you. If we do this, such third parties' use of your information will be bound by this Privacy Policy. We may store personal information in locations outside the direct control of Buzz360 (for instance, on servers or databases co-located with hosting providers). As we develop our business, we may buy or sell assets or business offerings. Customer, email, and visitor information is generally one of the transferred business assets in these types of transactions. We may also transfer or assign such information in the course of corporate divestitures, mergers, or dissolution.

Any personal information or content that you voluntarily disclose for posting to the Service becomes available to the public, as controlled by any applicable privacy or website customization settings. If you remove information that you posted to the Service, copies may remain viewable in cached and archived pages of the Service, or if other users have copied or saved that information.

Except as otherwise described in this Privacy Policy, Buzz360 will not disclose personal information to any third party unless required to do so by law or subpoena or if we believe that such action is necessary to (a) conform to the law, comply with legal process served on us or our affiliates, or investigate, prevent, or take action regarding suspected or actual illegal activities; (b) to enforce our Terms of Service, take precautions against liability, to investigate and defend ourselves against any third-party claims or allegations, to assist government enforcement agencies, or to protect the security or integrity of our site; and (c) to exercise or protect the rights, property, or personal safety of Buzz360, our users or others.

Non-Personally Identifiable Information: We may share non-personally identifiable information (such as anonymous usage data, referring/exit pages and URLs, platform types, number of clicks, etc.) with interested third parties to help them understand the usage patterns for certain Buzz360 services.

The nature of the Buzz360 services necessitates to publish data received from subscribers and to share this data with third parties.  You authorize Buzz360 to use the data you provided as Buzz360 sees necessary. Buzz360 cannot and will not be held liable for any use, abuse, misuse or violations of privacy or copyrights of any data entered into the system; we also can not guarantee that data will not be used in a way the subscriber may object to.

Security 

Your account is protected by a password for your privacy and security. You must prevent unauthorized access to your account and Personal Information by selecting and protecting your password appropriately and limiting access to your computer or device and browser by signing off after you have finished accessing your account.

We endeavor to protect the privacy of your account and other Personal Information we hold in our records, but we cannot guarantee complete security.  However, we do agree to continuously review, adopt, and utilize commercially reasonable standards with respect to any software, hardware, or processes we use on your (and our own) behalf to support privacy and security efforts and expectations.  Unauthorized entry or use, hardware or software failure, and other factors, may compromise the security of user information at any time.

Buzz360 Firewall Policy

This policy pertains to political campaigns and organizations and is intended to satisfy the requirements of FEC Regulations (CFR 109.21) regarding firewalls to prevent coordination between candidates and Organizations that make independent expenditures for the same candidates.

To prevent the actual coordination or even the appearance of coordination between a candidate and a 3rd party, no employee of Buzz360 shall work in a creative or consultative role with a candidate or their campaign and the independent expenditure organization supporting the same candidate during the same election cycle. Further, technical support tickets from independent expenditure organizations shall not be assigned to support personnel supporting a candidate benefiting from the organization's efforts.
